Buying property in NSW
Before you sign or bid, email us the contract. We’ll review the clauses that matter — title, inclusions, settlement period and special conditions — and advise on any changes to protect you. If you’re purchasing by private treaty, we’ll step you through the cooling-off position (usually five business days for most residential purchases) and when a s66W certificate might be appropriate to waive it.
Heading to auction? We’ll explain the risks of no cooling-off and make sure the contract is auction-ready. For strata and off-the-plan purchases, we look closely at by-laws, levies, disclosure statements, plan changes and sunset clauses, then tell you what’s normal, what’s negotiable and what’s a red flag. We begin with a short call to understand your goals and timing. You’ll receive a clear fee proposal and a simple document checklist. We also set expectations about the typical NSW timeline — many contracts use around 42 days from exchange to settlement, though this can be varied by agreement.
Buyers: we review the contract and reports, recommend practical amendments, and position you for a safe exchange.

We agree the final terms, manage deposit arrangements and formalise exchange. For private-treaty purchases, we explain your cooling-off rights and the implications of a s66W. For auctions, we ensure you understand that there is no cooling-off.
During any cooling-off period or agreed due diligence window, we finalise building/pest or strata inspections, respond to enquiries and make any last adjustments to the contract. We also coordinate with your lender or broker so loan documents, certifications and settlement bookings stay aligned.
We confirm rate and water adjustments, prepare settlement statements and guide you through transfer duty (generally payable within three months of exchange; some off-the-plan purchases may have different timing). Buyers complete a final inspection to ensure the property is in the agreed condition.

No. NSW settlements are electronic. We verify your identity, obtain your client authorisation and handle settlement on your behalf.
It’s a solicitor’s certificate that waives the buyer’s cooling-off rights. Sometimes it helps you secure a property in a competitive situation; other times it’s unnecessary or risky. We’ll advise based on your finance, the property and the contract.
We’ll diarise the due date and help arrange payment. The general position is within three months of exchange, although some off-the-plan purchases may have deferral options. Either way, we make sure timing doesn’t hold up settlement.
Most NSW matters settle on a timetable agreed in the contract — often around six weeks — but we regularly negotiate shorter or longer periods to match finance, lease ends and moving plans.
Both can complete a standard NSW transfer. Conveyancers are licensed property professionals and focus on conveyancing work. Solicitors are lawyers who can also advise on related legal issues (for example family law settlements, estates and tax implications), negotiate complex terms and act if a dispute arises. You don’t need to learn the statutes — we apply them for you — but in plain English the framework includes: the Torrens Title system and Real Property Act (how land is registered), the Conveyancing Act and Sale of Land Regulation (what has to be in a contract and how it’s exchanged), strata laws for apartments and townhouses, the Duties Act (transfer duty) and mandatory electronic conveyancing rules overseen by NSW Land Registry and ARNECC. It’s a council-issued certificate that discloses zoning, planning controls and certain hazards affecting the land. For most residential sales it must be attached to the contract so buyers know exactly what they’re purchasing.
Typically: the title search and deposited plan, the section 10.7 planning certificate, a sewer/drainage diagram, and inclusions list. For strata properties we also include the strata plan and by-laws. We’ll prepare or check these and explain anything unusual.
